Welcome to Afaje. By accessing or using Afaje, a platform that discovers and showcases apps at afaje.com (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of the Terms, please discontinue use immediately.

1. Acceptance of Terms

By accessing or using the Service, you agree to comply with and be bound by these Terms and all applicable laws and regulations. If you are acting on behalf of an organization, you warrant that you have authority to bind that organization to these Terms. Your continued use constitutes assent to any updates.

2. Changes to Terms

We may modify these Terms from time to time. We will publish notice of changes on afaje.com and update the Last updated date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

3. Use of the Service; Eligibility

You may use the Service only if you can form a binding contract with Afaje and are not barred from receiving the Service under applicable law. You must be at least the age of majority in your jurisdiction. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to comply with all applicable laws while using the Service.

4. Intellectual Property

All content and materials appearing on the Service, including but not limited to text, graphics, logos, images, software, and underlying code (the "Afaje Content"), are owned by Afaje or its licensors. The Afaje Content is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Afaje Content for informational purposes and as part of your use of the Service, subject to these Terms. You may not copy, reproduce, distribute, modify, create derivative works, reverse engineer, or otherwise exploit the Afaje Content except as expressly permitted by Afaje in writing or as required by law. All rights not expressly granted herein are reserved.

Trademarks and service marks contained in the Service are the property of Afaje or its licensors. Nothing herein grants you any rights to use Afaje's trademarks outside of the scope of this Agreement.

5. User Content

You may submit or post content to the Service, such as reviews or comments ("User Content"). By submitting User Content, you grant Afaje a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in connection with the Service and Afaje's business operations. You remain responsible for the ownership and legality of your User Content and for ensuring it does not infringe third-party rights.

6. Third-Party Links and Google Play-hosted Apps

The Service may include links to third-party apps that are hosted on Google Play or other platforms. Afaje does not host these apps on afaje.com; the apps are hosted and operated by third-party providers. We do not control, endorse, or warrant the accuracy, safety, or availability of any third-party apps or content. Your use of third-party apps is governed by the terms and privacy policies of those third parties (for example, Google Play's Terms of Service and Privacy Policy). Afaje is not responsible for the performance, security, or content of any such third-party apps, nor for any transactions you undertake with them.

7. Disclaimers and Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AFaje AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND NONINFRINGEMENT. AFaje DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. ACCESS TO THE SERVICE IS AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AFaje, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID AFaje, IF ANY, FOR THE SERVICE DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless Afaje and its affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you under these Terms will cease, and you must discontinue use of the Service. The terms that by their nature should survive termination shall survive.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Wilmington, Delaware, under the then-current rules of the American Arbitration Association, or, at the option of any party, in the state or federal courts located in Wilmington, Delaware. Each party waives the right to a jury trial to the maximum extent permitted by law. The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs.

12. Severability; Waiver; Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. A failure by either party to enforce any right or provision shall not constitute a waiver. These Terms, together with any policies referenced herein, constitute the entire agreement between you and Afaje regarding the Service and supersede all prior agreements relating to the Service.

13. General Provisions

Afaje reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time with or without notice. If you are using the Service outside the United States, you acknowledge that data may be transferred to servers located in other jurisdictions as described in Afaje's Privacy Policy. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
